Schaefer Addresses California Lawyers Association IP Law Section
On December 4, 2018, Matthew Schaefer presented a webinar to California Lawyers Association Intellectual Property Law Section addressing “Online Sales Tax Collection After Wayfair.” Schaefer, who served as co-counsel to the retailers in South Dakota v. Wayfair Inc., 138 S.Ct. 2080 (2018), described the challenges faced by multistate businesses in response to changes in state tax enforcement in the wake of the Supreme Court’s decision. In a post-Wayfair environment, Schaefer explained, vendors of a wide variety of products and services, including sellers of software, digital goods, and cloud computing, are likely to have greatly expanded states and local tax obligations, as states look to expand their taxes and taxing authority to remote businesses whose obligations were far more limited under the old “physical presence” standard of Quill Corp. v. North Dakota.
