Politico Quotes Peter Brann in Piece on Maine Senate Election

A Politico article on the state of Maine’s Senate race between incumbent Senator Susan Collins and her challenger, Speaker of the Maine House, Sara Gideon, quoted B&I partner Peter Brann on the potential impact of ranked-choice voting on the outcome. With the race close, it is possible that neither Collins nor Gideon will earn more than fifty percent of the vote, which would mean that voters’ second-choice ballots would determine the outcome. Brann, who represented Rep. Jared Golden in litigation over his victory in the 2018 congressional election in Maine’s second congressional district, noted that ranked-choice voting has survived all constitutional challenges to date. On the prospect of a possible legal challenge to the result by Senator Collins, Brann added, “Constitutional arguments aren’t like wine….They don’t improve with age.”
