Partner Peter Brann was featured in a news piece on WCSH-TV in Portland, “SCOTUS hears arguments in Maine tuition assistance program case.” On December 8, 2021, the Supreme Court heard oral argument in a case challenging a Maine rule that authorizes tuition assistance to Mainers in cities or towns without public schools to attend any public or private school without a religious affiliation. The plaintiffs in the case have challenged the constitutionality of the exclusion of religiously affiliated schools from the program. Brann, who served as Maine’s state solicitor before joining Brann & Isaacson, successfully defended the Maine program in prior cases. He cautioned, however, that the current Supreme Court appears to be leaning toward deeming the program unconstitutional, noting, “This Supreme Court has been very fiercely defensive of religious rights and has struck down a number of laws where public benefits were being made available and said they also have to be made available to religious institutions.”
