Martin Eisenstein, David Bertoni, and David Swetnam-Burland Speak at American Catalog Mailers Association Conference
Brann & Isaacson attorneys addressed members of the American Catalog Mailers Association at its annual conference in Washington, DC, from April 8-10, 2019. On April 8, managing partner Martin Eisenstein spoke to the conference in a panel called, “It’s a Wayfair World Now and We All Have to Live In It.” Eisenstein discussed the state tax landscape after the Supreme Court’s opinion in South Dakota v. Wayfair, including a new wave of state tax laws and a related wave of enforcement actions being undertaken by state and local jurisdictions to impose collection and remittance obligations on out-of-state businesses.
On April 10, partners David Bertoni and David Swetnam-Burland spoke on “Addressing the Challenges of California’s Privacy Act and Proposition 65.” They discussed the extra-territorial impact of the California Consumer Privacy Act, which is poised to impose wide-ranging data privacy obligations on retailers and other businesses when it goes into effect on January 1, 2020. They also covered revised warning label requirements of California Proposition 65, which went into effect last August. Both laws create compliance issues for businesses selling products into California, and require strategies for mitigating the risk of private class action litigation.
