Isaacson and Stitham Pen State Tax Notes Cover Story on The “Tampon Tax”
An article by senior partner George Isaacson and partner Stacy O. Stitham, “The ‘Tampon Tax’: Hidden Gender Bias in Medical Products Exemptions,” was the cover story of the September 16, 2019, issue of State Tax Notes. Isaacson and Stitham argue that the failure to exempt feminine hygiene products from sales taxes effectively enshrines gender bias into a number of state tax codes. The authors note that this bias can be easily remedied by state legislatures; but, failing legislative action, the courts may need to step in to address the underlying constitutional violation.
