Brann & Isaacson Litigators Defeat Motion To Dismiss Contract Dispute
Brann & Isaacson litigators Daniel Nuzzi and Eamonn Hart recently succeeded in fending off a motion to dismiss based on the alleged lack of personal jurisdiction over a Massachusetts defendant. On July 9, 2019, Justice MaryGay Kennedy of the Androscoggin County Superior Court issued a decision agreeing with B&I’s arguments on behalf of its client, E.W. Mailhot Sausage Company, a Lewiston business, and denied a motion to dismiss E.W. Mailhot’s complaint. The defendant, HeBo Family Foods, a Massachusetts business, failed to pay for approximately tens of thousands of dollars worth of product, after accepting delivery and then selling it. Brann & Isaacson prides itself on representing local businesses against out-of-state parties that seek to take advantage of them.
