Brann & Isaacson Lawyers File Motion to Dismiss ADA Website Lawsuit


Internet retailers and others have faced thousands of lawsuits across the country claiming that their websites are not accessible and thus violate the Americans with Disabilities Act. Because the plaintiffs usually price settlements at less than the cost of responding to the lawsuit, most companies settle them even though they believe their websites are accessible, and even though they want to make their websites accessible because it is good for business. Bucking this tide, TackleDirect asked Brann & Isaacson lawyers, Peter Brann and Hannah Wurgaft, to file a motion a dismiss the lawsuit. The plaintiff in this case, Yensy Contreras, represented by the law firm of Joseph Mizrahi and Edward Kroub, has filed 118 virtually identical lawsuits in the U.S. District Court for the Southern District of New York (S.D.N.Y.) since November 1, 2021.
