B&I Litigators Nuzzi and Hart Prevail in Disability Discrimination Lawsuit before Maine Supreme Court


On November 7, 2019, Brann & Isaacson litigators Daniel Nuzzi and Eamonn Hart were successful before the Maine Supreme Judicial Court, which affirmed a summary judgment in favor of B&I’s client, a Maine heavy construction firm.  In the case, a former employee brought suit claiming he was discriminated against due to a disability when he was terminated for job-site intoxication and for  violation of company safety rules.   The Superior Court granted summary judgment on the basis that the employee was not “otherwise qualified” for the position of a heavy equipment operator.   The case raised issues concerning the prohibition of the use or possession of alcohol in the workplace in light of an employee’s admitted alcohol dependency outside of work.  B&I regularly advises companies throughout Maine on employment matters and, when the need arises, vigorously defends them before federal and state agencies and courts.
