Kevin Haley Discusses Amazon Ruling In Internet Retailer


B&I Partner Kevin Haley was featured by Internet Retailer in an article on the implications of an opinion of the Ninth Circuit Court of Appeals against Amazon.com in an important trademark law case. The appellate panel reversed a trial judge’s dismissal of a complaint by Multi Time Machine against Amazon.com, alleging that Amazon’s search results could create consumer confusion because they could create the impression that Amazon.com sells products or product lines that it does not carry. In light of the appellate ruling, if it were proven that “‘this confusion actually exists in the marketplace,” Haley was quoted as saying, then “‘Amazon may have to stop engaging in presenting search results for products it doesn’t carry.’”
