B&I Lawyers Defend Internet Retailers in Major U.S. Supreme Court Tax Case


Brann & Isaacson partners George Isaacson, Martin Eisenstein, and Matthew Schaefer filed the Respondents’ Brief in the U.S. Supreme Court in the most important sales tax case affecting Internet retailers of the past 25 years. Representing three leading Internet retailers, Wayfair, Overstock, and Newegg, the B&I lawyers argue that the Supreme Court should not overturn the constitutional holding of Quill v. North Dakota, which for decades has barred States from requiring remote sellers which lack a physical presence in a state to collect sales tax. This is the second time in recent years that B&I lawyers have represented the interests of Internet retailers in the Supreme Court, prevailing last time 9-0 in DMA v. Brohl. The firm has represented over 100 companies in sales and use tax matters throughout the country.
