Wall Street Journal Quotes Peter Brann On Impact Of Major Supreme Court Patent Case


In a March 23, 2017, article, the Wall Street Journal quotes Partner Peter Brann on the potential impact of the Supreme Court’s decision in a major patent case, TC Heartland v. Kraft Foods Group Brands. The case, which is scheduled for oral argument on Monday, March 27, 2017, has the potential to put a stop to the scourge of forum shopping, rules under which patent trolls have been able to file patent infringement lawsuits in jurisdictions with plaintiff–friendly rules. In “High–Court Case to Challenge Jurisdiction ‘Shopping’ in Patent Suits,” the Journal quotes Brann as saying that the current rules have resulted in “an extraordinary concentration of patent cases in a handful of districts, most notably the Eastern District of Texas.” If TC Heartland prevails in the Supreme Court, Brann continued, “I think it will have a dramatic effect…on patent troll litigation,” by limiting the jurisdictions in which patent trolls can file new cases to those judicial districts with a connection to the accused infringer or the alleged infringement.

Brann and his partners, David Swetnam-Burland, and Stacy Stitham, filed an amicus curiae brief on behalf of 48 Internet companies, retailers, and associations in the U.S. Supreme Court, urging the Court to put an end to forum shopping by patent trolls and others.
